This Website is not for use by any minors (defined as those who are not at least 18 years of age), and you must not use this Website if you a minor.

Other than content you own, which you may have opted to include on this Website, under these Terms, Revel Nation Carnival and/or its licensors own all rights to the intellectual property and material contained in this Website, and all such rights are reserved. You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website,

You are expressly and emphatically restricted from all of the following:
1. publishing any Website material in any media;
2. selling, sublicensing and/or otherwise commercializing any Website material;
3. publicly performing and/or showing any Website material;
4. using this Website in any way that is, or may be, damaging to this Website;
5. using this Website in any way that impacts user access to this Website;
6. using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity;
7. engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;
8. using this Website to engage in any advertising or marketing;
Certain areas of this Website are restricted from access by you and Revel Nation Carnival may further restrict access by you to any areas of this Website, at any time, in its sole and absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality of such information.

4. Your Content.
In these Website Standard Terms And Conditions, “Your Content” shall mean any audio, video, text, images or other material you choose to display on this Website. With respect to Your Content, by displaying it, you grant Revel Nation Carnival a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.
Your Content must be your own and must not be infringing on any third party’s rights.

RevelNation Carnival reserves the right to remove any of Your Content from this Website at any time, and for any reason, without notice.

5. No warranties. This Website is provided “as is,” with all faults, and Revel Nation Carnival makes no express or implied representations or warranties, of any kind related to this Website or the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you.

6. Limitation of liability. In no event shall Revel Nation Carnival, nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and Revel Nation Carnival, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

7. Indemnification.
You hereby indemnify to the fullest extent Revel Nation Carnival from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

8. Severability.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein. 

9. Variation of Terms.
Revel Nation Carnival is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

10. Assignment.
Revel Nation Carnival shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, .you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

11. Entire Agreement. These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Revel Nation Carnival and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

12. Governing Law & Jurisdiction. These Terms will be governed by and construed in accordance with the laws of the State of Florida, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes.

Revel Nation Carnival takes COVID-19 very seriously and will take every precaution to ensure the safety of our masqueraders. We will be monitoring all local, state and CDC recommendations and requirements. The health and safety of our masqueraders and staff is paramount, therefore we ask that if you are feeling ill or have been exposed to COVID-19 within two weeks of the parade to please stay home.

In order to provide you with a premier service, we have a firm no refund policy. ALL SALES ARE FINAL and we cannot offer refunds for any reason, including a case of force majeure. No refunds will be given for pandemic or unplanned closures, weather conditions, natural disasters or other acts of God, sickness or any other reason. While we do not anticipate cancellations, Revel Nation Carnival reserves the right to cancel for any reason, including regulatory COVID-19 mandates. If Revel Nation is forced to postpone, reschedule or move, your costume reservation (including any additional add-ons, such as a Jouvert package) is still valid, and no further action is required. If the event is postponed, rescheduled or moved, you will be able to redeem your costume on the rescheduled date. Revel Nation will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event.

Terms and Conditions:

Payment Policy

In order to fully complete registration for your costume, you will be required to issue a non-refundable deposit of $200 for frontline and $200 for backline. A second non-refundable payment is due by _________. Thereafter, the final balance is paid via cash or _________ upon collection of your registered costume at our designated distribution center.

PLEASE NOTE THAT YOUR REGISTRATION WILL ONLY BE COMPLETED AND VALID WHEN THE ENTIRE DEPOSIT IS PAID IN FULL.

Disclaimers

1. Masqueraders who fail to issue the full payment by the collection date will forfeit partial payment of the deposit. No exceptions allowed!
2. Costumes remain the property of the band until paid in FULL and collected.

Refunds/Returns Policy

Please note that carnival costumes are custom-made items therefore once a down payment is made, it is non-refundable. Additionally, there will be:

•NO exchange or switching of sections
•NO changing of sizes or type of body piece ordered
•NO Costume Transfers
•NO Returns accepted

Delivery Policy

All costumes must be collected at the distribution center by the purchaser. You must present a valid form of identification (state issued ID or passport) at the time of collection. Alternatively, you may authorize another person to collect on your behalf. The authorized person must present a valid form of identification. Further instructions on the collection process will be given with the distribution schedule. The costume distribution schedule will be emailed to all masqueraders and posted on our social media (Instagram and Facebook). Different sections will have different distribution dates.

Consumer Data Privacy Statement

We are the sole owners of the information collected on this site. We only have access to collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request.

CREDIT CARD CHARGEBACK POLICY

A “chargeback” occurs when a customer disputes a credit card charge. A fraudulent chargeback occurs when a customer attempts to dispute a charge for merchandise that they have knowingly purchased and have returned for a refund.

Attempting to dispute a valid credit card charge is fraudulent and is illegal in most states. Revel Nation, does not tolerate chargeback fraud, and we follow the following procedure when this takes place:

1. If you attempt to dispute or deny a valid charge, we will first contact you directly, because many disputed charges occur as a result of the customer not recognizing our charge on their statement. You will have 5 (five) calendar days to reverse your dispute upon receipt of our letter.

2. We will immediately begin the process of fighting your chargeback, using all available information including a correct address verification service and card security code match on your order, proof-of-delivery of our costume, copies of any and all emails you have sent us, and a search of your social media accounts for any mention that you have purchased our costume. Be aware that your bank may charge you additional fees if you lose your dispute.

If your chargeback appears to be so-called “Friendly Fraud” – an attempt on your part to defraud us and abuse the chargeback process to obtain our costume for free, we may file a police report with your local law enforcement agencies.

3. Your account will be turned over to our attorney, who will initiate collection activities as well as report your account as delinquent to all of the major credit bureaus. We also contract with collection agencies abroad.

4. If you still do not resolve the situation by either reversing the dispute or reimbursing us for the amount disputed plus our bank fees, we reserve the right file a civil lawsuit against you in Broward County, Florida court for the amount disputed, for bank fees related to the chargeback, for additional damages for the harm your chargeback causes to our merchant credit record, and for punitive damages as the courts do not take credit card fraud lightly.
